General Terms and Conditions of the engelsklang.com Online Shop

The following provisions of the General Terms and Conditions version effective at the point of time when a particular contract is being concluded shall apply to all and any business relations generated via engelsklang.com and established between the engelsklang oHG (herein referred to as “engelsklang“) and its customers.

Prices

All quoted prices include the German VAT.

Cancellation of Order

The right to cancel an order does not apply to any contract concerning the supply of sealed goods (audio and video recordings or software) if the sealed packaging has been opened by the customer.

The customer shall be entitled to withdraw from the contract within the period of two weeks by returning the goods to engelsklang. This provision shall be regarded as complied with if the goods are dispatched by the customer in a timely manner.

In case of a withdrawal, engelsklang shall reimburse the paid/transferred sales price, if the sales price has already been transferred/paid by the customer and has already been received by engelsklang. If the quality of the goods has significantly deteriorated or if the goods have gone astray, engelsklang shall be entitled to reduce the amount to be refunded to the customer by the particular diminution of value.

The freight charges for returning those goods the value of which does not exceed €40 shall be covered by the customer unless the goods delivered correspond to the goods ordered. In case of an effective withdrawal, the customer shall be obliged to release the received goods. If the customer returns the goods with the goods being subject to a deterioration in quality due to usage or handling by the customer, the customer shall be committed to paying compensation for the reduced value. However, this does not apply if the deterioration of the quality of the goods was solely caused by checking the goods, as the customer could have done in the shop. The obligation to pay compensation can be avoided by not using the goods like an owner and by avoiding everything that impairs the value of the goods.

Important when Returning the Goods

Please put sufficient postage on the return consignment and state your full address as well as the particulars about your bank account for possible refunding. Please note that engelsklang will not accept any non-prepaid deliveries.

Delivery, Conditional Delivery

The goods are delivered ex works and can usually by dispatched by mail within 5 days. Delivery will be effected subject to the pre-condition that engelsklang itself has received the requested goods in time. In case of supply bottlenecks, the customer will be informed immediately, and any payments already made by the customer will be refunded.

We reserve the right to supply all articles in customary quantities only.

Retention of Title

The delivered goods shall remain the property of engelsklang until they have been fully paid for.

Data Protection

engelsklang herewith confirms that any customer-related data will be saved and used for contract settlement and marketing purposes only. Of course, all data will be kept in confidence.

Final Clause

If the customer is a merchant, the sole place of jurisdiction shall be Seligenstadt, Germany, concerning all and any claims in connection with the business relation. If a provision of the supply contract or of these General Terms and Conditions becomes fully or partially invalid or ineffective, the validity or effectiveness of the other provisions shall not be affected by the full or partial invalidity or ineffectiveness of the particular provision.
